Terms of Service

By accessing or using WashIQ you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction), that you have the authority to enter into these Terms — including on behalf of any business you represent — and that you accept these Terms in full.

If you do not agree with any part of these Terms, you may not use the service.

For the purpose of these Terms:

• "Operator" means Ali Özyıldırım, who self-hosts and operates WashIQ.
• "Platform" means the WashIQ web app, mobile apps, APIs and all related software and infrastructure.
• "Customer" means an end user who books a car-wash service through the marketplace.
• "Business" means a car-wash operator that uses WashIQ to manage its locations.
• "Wash" means a service provided by a Business to a Customer through the Platform.

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account.

You must notify the Operator immediately at [email protected] if you suspect unauthorized access. WashIQ is not liable for losses resulting from credentials you failed to secure.

You agree not to:

• Use the Platform for any unlawful, fraudulent or harmful purpose.
• Reverse-engineer, scrape or attempt to gain unauthorized access to the Platform or any related system.
• Upload content that infringes the rights of any third party, including IP, privacy or publicity rights.
• Interfere with or disrupt the Platform, including by introducing malware, denial-of-service or excessive automated traffic.
• Use the Platform to compete with WashIQ, to build a competing product, or to benchmark performance without prior written consent.

Businesses subscribe to WashIQ on a recurring monthly or annual basis. The applicable plan, price and billing cycle are presented on the pricing page and confirmed at checkout. Subscriptions auto-renew until cancelled. You may cancel at any time from the dashboard; the cancellation takes effect at the end of the current billing period and no refunds are issued for the unused portion, except where required by mandatory consumer law.

All fees are stated in the currency shown at checkout and are exclusive of VAT and any other applicable taxes, which will be added at the rate then in force. Payments are processed by Stripe.

Where a Customer books a Wash through the marketplace, the Customer pays the Business via Stripe and WashIQ deducts a commission of 8% from the total wash price, plus a 0.5% payment-processing markup on top of Stripe's own fees. The remaining amount is paid out to the Business according to Stripe's payout schedule.

Each Business is solely responsible for the quality of its services, for issuing legally compliant invoices to its Customers, and for paying its own taxes. WashIQ is a technology intermediary; it is not party to the wash contract concluded between Customer and Business.

Featured listings, promoted ranking and other revenue add-ons are offered as separate paid placements with prices disclosed in the dashboard.

Refund decisions for individual washes are made by the Business that delivered them. WashIQ will assist with mediation but does not guarantee any refund. If a chargeback is filed, WashIQ may withhold an equivalent amount from future payouts to the Business pending resolution. Mandatory statutory rights of consumers under Turkish and EU consumer law remain unaffected.

You retain ownership of the content you upload (photos, reviews, business logos, branding assets). You grant WashIQ a worldwide, royalty-free, non-exclusive licence to host, reproduce, adapt and display this content solely for the purpose of operating and improving the Platform.

You are solely responsible for the legality of content you upload. WashIQ may remove content that violates these Terms or applicable law.

The WashIQ name, logo, design system, source code, dashboards, the AI pricing engine and all related intellectual property belong exclusively to the Operator. Nothing in these Terms transfers any ownership to you.

Subject to your continued compliance with these Terms, the Operator grants you a limited, non-transferable, non-exclusive, revocable licence to use the Platform for its intended purpose.

The Platform integrates third-party services including Stripe (payments), Firebase Cloud Messaging (push notifications) and the OpenStreetMap Nominatim service (geocoding and map tiles). Your use of these third-party services is subject to their own terms and privacy policies. WashIQ is not responsible for the availability or behaviour of third-party services.

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, the Operator disclaims all warranties — express, implied or statutory — including merchantability, fitness for a particular purpose and non-infringement.

WashIQ does not warrant that the Platform will be uninterrupted, error-free, secure against all attacks, or that the AI suggestions (pricing, upsell, dirt detection) are accurate in every case. Businesses remain solely responsible for the pricing and quality of services they sell.

To the maximum extent permitted by law, the Operator's total cumulative liability arising out of or related to the Platform is limited to the greater of (a) the fees paid by you to WashIQ in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred Euros (€100).

Under no circumstances will the Operator be liable for indirect, incidental, consequential, special, exemplary or punitive damages, loss of profits, loss of business, loss of data or loss of goodwill, even if advised of the possibility of such damages.

You agree to defend, indemnify and hold harmless the Operator from any and all claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your use of the Platform, your breach of these Terms, or your violation of any law or the rights of any third party.

The Operator may suspend or terminate your access immediately if you breach these Terms, if continued service would expose the Operator to legal risk, or if your account remains inactive for more than 24 consecutive months.

You may terminate your account at any time from the dashboard. Upon termination, your data will be retained or deleted in accordance with the Privacy Policy.

We may revise these Terms from time to time. Material changes will be communicated by email or by an in-app notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Istanbul Çağlayan Courts and Enforcement Offices (İstanbul Çağlayan Mahkemeleri ve İcra Daireleri). Mandatory consumer-protection rights remain unaffected.
